Please check that these Terms contain everything which you want and nothing that you are not willing to agree to. By becoming a Finders Keepers Club Member, visiting or purchasing from the finderfskeepersclub.co.uk website, it will constitute agreement to be bound by the terms and conditions listed below in this contract.

UK Consumer Rights Summary

As a Finders Keepers club Member and customer, you are protected by UK consumer law. This is a summary of your rights as a consumer, when buying from any UK based e-commerce or online store. This summary does not represent or replace our contractual terms of service and is solely a summary and guide to help you understand some of your key rights:

The Consumer Rights Act 2015 says goods must be as described, fit for purpose and of satisfactory quality. During the expected lifespan of your product, you are entitled to the following:

If your goods are faulty you can get a refund, up to 30 days
For up to six months, if the goods are faulty and cannot be repaired or replaced, you are entitled to a full refund, in most cases.

The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 say that up to 14 days after receiving your goods, in most cases, you can change your mind, return the goods and get a full refund.

This contract sets out:
your legal rights and responsibilities;
our legal rights and responsibilities; and
certain key information required by law.

In this contract:

‘We’, ‘us’ or ‘our’ means Finders Keepers Club Limited, and ‘You’ or ‘your’ means the person using our site to buy goods from us.

1. Introduction

1.1 If you buy goods on our www.finderskeepersclub.co.uk website you agree to be legally bound by this contract.

1.2 You may only buy goods from our website for non-business reasons.

1.3 Only individuals who are registered  Finders Keepers Club Members may purchase from the finderskeepersclub.co.uk website. To find out more about Finders Keepers Club Membership, please see https://www.finderskeepersclub.co.uk/pages/join-now.

1.4 We reserve the right to refuse service to anyone, for any reason at any time, at our sole discretion.

1.5 This contract is only available in English. No other languages will apply to this contract.

1.6 When buying any goods, you also agree to be legally bound by:

1.6.1 our website terms and conditions;
1.6.2 our Finders Keepers Club Membership terms and conditions and rules
1.6.3 specific terms which apply to certain goods. If you want to see these specific terms, please visit the relevant webpage for the goods at any time during the online checkout process.

1.7 A breach or violation of the terms of this contract will result in the cessation of your Finders Keepers Club services, including Finders Keepers Club Membership status and access to e-commerce services.

1.8 All of the above documents form part of this contract (as though set out in full here).

2. Information we give you

2.1 By law, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 say that we must give you certain key information before a legally binding contract between you and us is made. If you want to see this key information, please:

2.2 The key information we give you by law forms part of this contract (as though it is set out in full here).

2.3 If we have to change any key information once a legally binding contract between you and us is made, we can only do this if you agree to it.

3. Your privacy and personal information

3.2 Your privacy and personal information are important to us. Any personal information that you provide to us will be dealt with in line with our Privacy Policy, which explains what personal information we collect from you, how and why we collect, store, use and share such information, your rights in relation to your personal information and how to contact us and supervisory authorities if you have a query or complaint about the use of your personal information.

4. Ordering goods from us

4.1 Below, we set out how a legally binding contract between you and us is made.

4.2 You place an order on the site through the www.finderskeepersclub.co.uk checkout process. Please read and check your order carefully before submitting it. If you need to correct any errors in your order, you can do so before submitting your order to us.

4.3 When you place your order at the end of the online checkout process (e.g. when you click on the “pay now” button or equivalent), we will acknowledge your order by email. This acknowledgement alone does not, however, mean that your order has been accepted.

4.4 We may on occasions contact you to say that we do not accept your order. This is typically for the following reasons:

4.4.1 the goods are unavailable;
4.4.2 we cannot authorise your payment;
4.4.3 you are not allowed to buy the goods from us (e.g. if your Finders Keepers Club Membership has expired);
4.4.4 we are not allowed to sell the goods to you (e.g. if we have evidence that you are acting as a business and reselling the goods bought on our website, which breaches our contracts with our suppliers);
4.4.5 there has been a mistake on the pricing or description of the goods.
4.4.6 we do not deliver to the address you have requested

4.5 We will only accept your order when we email you to confirm this (Confirmation Email). At this point:

4.5.1 a legally binding contract will be in place between you and us; and
4.5.2 we will dispatch the goods to you.

4.6 If you are under the age of 18 you may not become a Finders Keepers Club Member nor can you buy any goods or services from the www.finderskeepersclub.co.uk website.

4.7 The goods displayed on our website and in our marketing materials are usually very limited in their quantity. We operate a strict “when it is gone, it is gone” policy; we do not replenish stock and cannot guarantee availability of the products that we advertise. We will always make all possible efforts to display available stock levels on our website, but this does not constitute a guarantee of availability of those items.

4.8 We reserve the right to limit the number of items of a particular product that can be bought by our Members from our website. We will implement this policy on a case-by-case basis, at our discretion.

4.9 We reserve the right to limit or prohibit orders that, in our sole judgement, appear to be placed by dealers, resellers or distributors.

5. Right to cancel

5.1 You have the right to cancel this contract within 14 days without giving any reason.

5.2 The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods or the last lot or piece of an order.

5.3 To exercise the right to cancel, you must inform us of your decision to cancel this contract by a clear statement (e.g. a letter sent by email) using hello@finderskeepersclub.co.uk

5.4 To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.

6. Effects of cancellation

6.1 If you cancel this contract, we will reimburse to you payments received from you for the goods, (the refund therefore excludes the costs of delivery).

6.2 We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you of the goods received by you.

6.3 We will make the reimbursement without undue delay, and not later than:

6.3.1 14 days after the day we received back from you any goods supplied; or
6.3.2 (if earlier) 14 days after the day you provide evidence that you have returned the goods; or
6.3.3 if there were no goods supplied, 14 days after the day on which we are informed about your decision to cancel this contract.

6.4 We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.

6.5 We may, on occasions, withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

6.6 If you have received goods:

6.6.1 you shall send back the goods without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired;
6.6.2 you will have to bear the direct cost of returning the goods, and
6.6.3 you are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods. Unnecessary handling includes removal of labels and swing tags from goods.

7. Delivery

7.1 The estimated date for the delivery of the goods is set out in the Confirmation Email (see clause 4.5).

7.2 If something happens which:

7.2.1 is outside of our control; and
7.2.2 affects the estimated date of delivery;

we will let you have a revised estimated date for delivery of the goods.

7.3 Delivery of the goods will be deemed to have taken place when we deliver them to the address that you gave to us.

7.4 Unless you and we agree otherwise, if we cannot deliver your goods within 14 days, we will:

7.4.1 let you know;
7.4.2 cancel your order; and
7.4.3 give you a refund.

7.5 You are responsible for the goods when delivery has taken place. In other words, the risk in the goods passes to you when you take possession of the goods.

7.6 We do not make deliveries to any addresses outside of the UK.

7.7 We may deliver your goods in instalments, when you have placed multiple item orders.

8. Payment

8.1 We accept the following credit cards, debit cards and payment providers: VISA, AMEX, Mastercard, Maestro, PayPal, Google Pay and Apple Pay. We do not accept cheques, cyber-currency or cash.

8.2 We may without prior notice, at our discretion, change the payment services that we make available on our website, www.finderskeepersclub.co.uk

8.3 We will do all that we reasonably can to ensure that all of the information you give us when paying for the goods is secure by using an encrypted secure payment mechanism. However, in the absence of negligence on our part, any failure by us to comply with this contract or our Privacy Policy (see clause 3) or breach by us of our duties under applicable laws we will not be legally responsible to you for any loss that you may suffer if a third party gains unauthorised access to any information that you give us.

8.4 All payments by credit card or debit card need to be authorised by the relevant card issuer. We may also need to use extra security steps via processes including but not limited to:

8.4.1 Verified by Visa; or
8.4.2 Mastercard® SecureCodeTM ; or
8.4.3 American Express SafeKey

8.5 If your payment is not received by us and you have already received the goods, you:

8.5.1 must pay for such goods within 14 days, or
8.5.2 must return them to us as soon as possible. If so, you must keep the goods in your possession, take reasonable care of them (including ensuring that you follow any instructions or manuals given with the goods) and not use them before you return them to us.

8.6 If you do not return any goods (such as where you have not paid for them) we may collect the goods from you at your expense. We will try to contact you to let you know if we intend to do this.

8.7 Nothing in this clause affects your legal rights to cancel the contract during the ‘cooling off’ period under clauses 5 and 6.

8.8 The price of the goods showed on www.finderskeepersclub.co.uk and in our marketing and promotional materials:

8.8.1 is in pounds sterling (£, GBP);
8.8.2 includes VAT at the applicable rate; and
8.8.3 does not include the cost of:
(a) delivering the goods and
(b) any special packaging you specify in your checkout process
8.8.4 All prices on www.finderskeepersclub.co.uk webpages and any/all Finders Keepers Club promotional material are subject to change without notice
8.8.5 We will not be liable to you for any changes in price.

9. Nature of the goods

9.1 The Consumer Rights Act 2015 gives you certain legal rights (also known as ‘statutory rights’), for example, the goods:

9.1.1 are of satisfactory quality;
9.1.2 are fit for purpose;
9.1.3 match the description, sample or model; and

9.2 We must provide you with goods that comply with your legal rights.

9.3 The packaging of the goods may be different from that shown on the site.

9.4 While we try to make sure that:

9.4.1 all weights, sizes and measurements set out on the site are as accurate as possible, there may be a small tolerance of up to 5% in such weights, sizes and measurements
9.4.2 the colours of our goods are displayed accurately on the site, the actual colours that you see on your computer may vary depending on the monitor that you use.

9.5 Any goods sold:

9.5.1 at discount prices;
9.5.2 as remnants; or
9.5.3 as substandard;

will be identified, described and sold as such. Please check that they are of a satisfactory quality for their intended use before you commit to a purchase.

9.6 If we can’t supply certain goods, we may need to substitute them with alternative goods of equal or better standard and value. In this case:

9.6.1 we will let you know if we intend to do this but this may not always be possible; and
9.6.2 you can refuse to accept such substitutes in which case we will offer you a refund or a replacement and let you know how long such an offer remains open for.

10. Faulty goods

10.1 Your legal rights under the Consumer Rights Act 2015 (also known as ‘statutory rights’) are set out at the top of this contract. They are a summary of some of your key rights. For more detailed information on your rights and what you should expect from us, please:

10.2 Nothing in this contract affects your legal rights under the Consumer Rights Act 2015 (also known as ‘statutory rights’). You may also have other rights in law.

10.3 Please contact us using hello@finderskeepersclub.co.uk, if you want:

10.3.1 us to repair the goods;
10.3.2 us to replace the goods;
10.3.3 to reject the goods and get a refund.

11. End of the contract

If this contract is ended it will not affect our right to receive any money which you owe to us under this contract.

12. Accuracy of account and billing information

12.1 You agree to provide current, complete and accurate information regarding your Finders Keepers Club Membership account.

12.2 Not maintaining complete and accurate records in your Finders Keepers Finders Keepers Club Membership account, can at our sole discretion be grounds for your Finders Keepers Club status being revoked.

12.3 You agree to promptly update your Membership account and other information including name, email address, credit card numbers and expiration dates, so that we can complete the transactions and contact that you request from us.

13. Errors, inaccuracies and omissions

13.1 Occasionally there may be information on our webpages that includes typographical errors, inaccuracies or omissions that may relate to pricing, promotions, offers, delivery charges, delivery timings and availability.

13.2 We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information, or if needed cancel orders, if any information in the Finders Keepers Club website or marketing materials is inaccurate, at any time without prior notice.

13.3 We will always take all necessary care and attention when we put information on our website, however, we undertake no obligation to update, amend or clarify information on our website, including without limitation pricing, except as required under UK consumer law.

14. Third Party Links

14.1 On occasions we will provide links from our webpages to third party sites.

14.2 Third party links on our website may direct you to third party website that are not affiliated to Finders Keepers Club. We are not responsible for the accuracy of the content of the webpages associated with these links, or the functioning of these links.

14.3 We are not liable for any harm or damages related to the purchase or use of goods, service and resources that result from a transaction with any third party website. Please review carefully the third party’s policies and practices and make sure you understand and agree with them before you engage in any transaction

14.4 Any complaint, claims, comments or questions regarding third party websites and their products or services should be directed to that third party

14.5 User comments, feedback and suggestions

14.6 If, either with or without our request you send us submissions including but limited to creative ideas, proposals, plans, feedback, by post, telephone, email or social media channels, you agree that we may, at any time and without restriction edit, copy, publish, distribute, translate or otherwise use in any medium the comments that you send to us. You agree that we are under no obligation to:

14.6.1 Maintain any comments or submissions in confidence;
14.6.2 Pay compensation for any comments or content submitted to us;
14.6.3 Respond to any comments or submissions.

14.7 We may, at our sole discretion monitor, edit or remove content from our finderskeepersclub.co.uk website (e.g. reviews) that are unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene or in any way violates any party’s intellectual property copyright or the terms set out in this contract

14.8 You agree that any comments you transmit to us or post on our website will not violate any rights of any third party, including copyright, trademarks, contractual obligations, privacy, or proprietary rights.

14.9 You agree that your comments, as posted on our webpages or submitted to Finders Keepers Club will not contain obscene, libellous, abusive or otherwise unlawful material, or contain any computer virus or malware that could in any way impact on the operation of the Finders Keepers Club service and website.

14.10 You may not use a false email address, pretend to be someone other than yourself, or in any way mislead us as the origins of any comments

14.11 You are solely responsible for any comments you make on Finders Keepers Club webpages, and their accuracy

14.12 We take no liability or responsibility for any comments that you post or submit

15. Limit on our responsibility to you

15.1 Except for any legal responsibility that we cannot exclude in law (such as for death or personal injury) or arising under applicable laws relating to the protection of your personal information, we are not legally responsible for any losses that:
(a) were not foreseeable to you and us when the contract was formed;
(b) that were not caused by any breach on our part;

16. Prohibited uses

16.1 In addition to other prohibitions as set forth in this contract, you are prohibited from using the Finders Keepers Club site or its content:

16.1.1 for any unlawful purpose;
16.1.2 to solicit others to perform or participate in any unlawful acts;
16.1.3 to violate any international or UK regulations, rules, or laws;
16.1.4 to infringe upon or violate our intellectual property rights or the intellectual property rights of others;
16.1.5 to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;
16.1.6 to submit false or misleading information;
16.1.7 to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Finders Keepers Club service or of any related website, other thirds party websites, or the Internet;
16.1.8 to collect or track the personal information of others;
16.1.9 to spam, phish, pharm, pretext, spider, crawl, or scrape;
16.1.10 for any obscene or immoral purpose;
16.1.11 or to interfere with or circumvent the security features of the Finders Keepers Club webpages or services or any related website, other websites, or the Internet.

16.2 We reserve the right to terminate your Finders Keepers Club Membership and/or the use of the Finders Keepers Club service for violating any of the prohibited uses.

17. Disputes

17.1 We will try to resolve any disputes with you quickly and efficiently.

17.2 If you are unhappy with:

17.2.1 the goods;
17.2.2 our service to you; or
17.2.3 any other matter,

17.3 If you want to take court proceedings, the courts of the part of the United Kingdom in which you live will have non-exclusive jurisdiction in relation to this contract.

17.4 The laws of England and Wales will apply to this contract.

17.5 Each of the paragraphs of these Terms operates separately. If a court finds part of these Terms is illegal, the rest will continue in full force and effect.

18. Third party rights

No one other than a party to this contract has any right to enforce any term of this contract.
